Just a little PSA for those driving around the borderlands this weekend: I’ve personally talked to two (non-white) people who have been stopped by police not for any driving infractions but simply to check immigration status. Just so you know, outside of designated border patrol stops in these areas, this is NOT normal. One was driving to LA from Phoenix and the other was driving in the desert between Tucson and San Diego. They are both Americans, one Latina and one black woman. If you live within 100 miles of a border (that includes coastlines, so 60% of Americans), please know your rights (or lack thereof, I guess).

  1. Thanks for posting this, Jackie. Knowing your rights is essentially the legal equivalent of first responder training–it teaches you what to do until expert help arrives. The ACLU is a great source for this information and has dozens of primers including for protests, immigration, searches & warrants, and traffic stops. Highly recommended for everyone.

    1. Couldn’t agree more. I was, personally, shocked to learn this border region thing a few years ago and even more shocked to learn that it includes coastlines. Of course, it’s more enforced near actual land borders, and living in San Diego brought it to my attention, but most people in the country live within this jurisdiction and don’t even know (like me, my whole life living in NY & CT).

    2. It was definitely one of the more eye-opening things I learned in law school–along with the fact that that the 4th amendment basically doesn’t apply at border crossings.
